MAKING PURCHASES
If you wish to purchase products or services described on this website, you may be asked to supply certain information including credit card or other payment information. You agree that all information that you provide will be accurate, complete, and current. You agree to pay all charges, including shipping and handling charges, incurred by users of your credit card or other payment mechanism at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchases.

PERSONAL INFORMATION
Personally identifiable information relating to you collected on this website or the Soul Improvisations Online Services will be collected, used, maintained and disclosed in accordance with the Company’s privacy policy set forth herein.

PRIVACY POLICY
If you place an order in our online store, sensitive personal identifying information may be collected, such as address and telephone number. Credit card information is not collected nor stored by us, but when you enter credit card information as part of placing an order in our online store, that data is encrypted by our payment processor. If you have placed an order in our store, we will not be able to erase all of the personal data. Under the relevant EU regulations, overriding legitimate interests may prevent us from erasing all of the data. For customers with transaction history, U.S. Internal Revenue Service Regulations require us to keep records of sales history for up to 7 years, so we are not permitted to erase your transaction data. We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. We may do so when: (1) required by law; or, (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; or, (3) investigating fraud which has already taken place. Your personally identifiable information is kept secure. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information. When you enter sensitive personal identifying information (such as when making a purchase in our Online Store), we encrypt that information using secure socket layer technology (SSL). Sensitive personal identifying information may include your name, address, telephone and credit card number, as may be applicable. While we work very hard to protect your privacy, no method of security is 100% effective and we cannot be responsible for the actions of those who may gain unauthorized access to your personal information. The Company makes no warranties, express, implied or otherwise as to the ultimate effectiveness of these reasonable and appropriate safeguards. We reserve the right to make changes to this policy from time to time. Any changes to this policy will be posted here.

NO RETURNS, EXCHANGES OR REFUNDS*
All products sold by the Company are unique and produced only once ordered. Due to the policies of our various manufacturing facilities and suppliers, we are unable to offer returns, exchanges or refunds except under the following limited circumstances:* (1) If you place an order for any items which we are later informed are out of stock or otherwise unavailable, following our receipt of such information from our suppliers we will notify you and issue a full refund for the cost of the item and applicable taxes; (2) If any item arrives in a defective or damaged condition and you notify us via email at support@designsbysoul.com within five (5) business days following your receipt of the item and provide supporting documentation and photos of the respective damage/defect, we will issue a full refund for the cost of the item and applicable taxes or provide a replacement. You will remain responsible for the shipping charges of all items which are received by you, as we are unable to issue any refunds for the cost of shipping. Except as stated in items (1) and (2) above, all sales are final. We do not offer any money-back guarantees.

PRODUCT INFORMATION
We have made every effort to display our products and their colors as accurately as possible. However, the displayed colors of the products will depend upon the technical specifications and settings of the computer and monitor of the user, and we do not guarantee that the actual colors of the products will be accurately displayed on the user’s monitor. Products displayed may be out-of-stock, discontinued or otherwise unavailable, and prices are subject to change. We are not responsible for typographical errors regarding price or any other matter, and we cannot guarantee that any descriptions are totally accurate, complete, reliable or error-free. You agree that you will not use the products for any commercial, business or re-sale purposes.

ORDERING AND AVAILABILITY
Products may be ordered by clicking on the items you wish to purchase and then following the prompts that will appear on the screen. You may check and correct any input errors in your order up until the point at which you submit your order to us. All orders are subject to acceptance by us and subject to availability based on our various suppliers. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by submitting an order, you enter into an obligation to pay for the product(s) when you order is shipped.

DELIVERY
Due to the policies of our various suppliers, delivery times can range from eight (8) to ten (10) business days in the United States. Please note that because we sell a wide variety of merchandise and utilize suppliers and manufacturing facilities in different locations, some of your products may be delivered to you in separate shipments and arrive at different times. We are not responsible for any delays in shipping.

RISK AND OWNERSHIP
The product(s) ordered will be at your risk from the time of delivery or collection (as the case may be). Ownership of the product(s) ordered will also pass to you on delivery or collection (as the case may be), provided full payment of all sums due in respect of the product(s), including any delivery charges, has been received.

PRICE AND PAYMENT
The price of products is as quoted on the website from time to time. Prices are subject to taxes to be paid by the purchaser, where applicable, and do not include shipping and handling, which will be automatically added (at the cost shown) to the total amount due when you view the items in your shopping basket and have selected your chosen delivery method.

You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorize payment for any reason. We also carry out a standard pre-authorization check on your payment card, and products will not be dispatched until this pre-authorization check has been completed. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.

From time to time we may run promotions where we issue discount codes, subject to the terms and conditions under which they were issued (as indicated in our relevant promotion from which you got the code). Discount codes can only be used once, and only during the period of validity stated and only in respect of the relevant product(s) stated. Discount codes cannot be redeemed for cash.
